General Terms and Conditions (AGB)

1. Scope

These terms apply to all contracts between Jeffrey Hart, trading as J.H. Digital Business Solutions, ("we") and users ("customer") regarding the use of the software-as-a-service application EWKPilot. Deviating terms of the customer only apply if we have expressly agreed to them in writing.

2. Description of services

EWKPilot helps producers and importers of single-use plastic products manage their obligations under the EWKFondsG: product catalog, quantity reporting, levy calculation, and export functions for reporting to the UBA platform DIVID. The scope of features depends on the chosen plan (Free/Starter/Pro); see the pricing overview on the website.

3. Conclusion of contract

The contract is concluded through registration (creating an account and selecting a plan). Paid plans (Starter/Pro) require a payment method to be added; billing is handled via our payment provider, Stripe.

4. Prices and payment terms

The prices stated on the website at the time the contract is concluded apply, plus statutory VAT where applicable. Paid plans (Starter/Pro) start with a 14-day free trial period; afterwards, the stored payment method is charged automatically according to the chosen billing interval (monthly or annual) unless cancelled beforehand.

5. Term and termination

Paid plans can be billed either monthly or annually. With annual billing, the contract runs for the paid annual period and can be cancelled at the end of that period; no refund is given for the current period. With monthly billing, a minimum term of 12 months applies from the start of the contract; after that, the contract can be cancelled at any time effective at the end of the current billing period. Cancellation is done via the customer portal (Settings → Cancel subscription). After cancellation, access remains available until the end of the already-paid or contractually agreed period. The Free plan can be ended at any time by deleting the account.

6. Customer obligations and responsibility

The customer is solely responsible for the accuracy of the data they enter (in particular product details and quantity reports) as well as for the timely submission of their reports to the competent authority (UBA platform DIVID). EWKPilot generates export files and calculations as an aid, but does not replace the customer's own review.

7. Limitation of liability and warranty

EWKPilot does not replace legal or tax advice. The levy calculation is performed to the best of our knowledge based on the EWKFondsV, but without guarantee of completeness or accuracy of the underlying rates and regulations.

The customer alone is responsible for the accuracy of reports submitted to authorities. We are only liable for damages arising from intent or gross negligence, and under the provisions of the Product Liability Act. In the case of slightly negligent breach of material contractual obligations (cardinal obligations), our liability is limited to the damage typically foreseeable for this type of contract.

9. Changes to these terms

We reserve the right to amend these terms with effect for the future, insofar as this is necessary for legal or technical reasons. We inform customers of material changes by email; if the customer does not object within six weeks, the amended terms are deemed accepted.

10. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants is Braunschweig. Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
